A User who has one or more vehicles and rents them out to renters under these terms. May also be referred to as the “Vehicle owner”.

1. Validity of the agreement

1.1. These terms and conditions are binding on all persons who use the services provided by CamperPass and who conclude rental agreements through the platform.

1.2. CamperPass reserves the right, at its sole discretion, to change or supplement the content of these terms. The latest valid version of the terms is always published on the platform.

1.3. If the terms and conditions are materially changed or supplemented, you will be informed the next time you log in to the platform or by an email notification. By continuing to use the platform after the changes, the User is deemed to agree to all changes and additions. If the User does not agree with the changes, they must stop using the services and close their account.

1.4. If the owner and the renter have accepted user agreements in different languages and there are discrepancies between them, the Lithuanian version of the agreement shall apply.

2. The platform

2.1. The User understands that the main purpose of the CamperPass platform is to connect vehicle owners and renters so that they can conclude rental agreements with each other through the platform. CamperPass provides the necessary tools but does not have complete and detailed information about, or direct involvement in, the communication between users and the vehicles offered on the platform.

2.2. CamperPass is not a party to any rental agreement and therefore has no legal or financial liability under such an agreement. The platform generally does not offer its own vehicles for rent, but only acts as an intermediary between users. Vehicles may be displayed on the platform for testing or advertising purposes. CamperPass has the right to review the information provided by users on the platform.

2.3. The User agrees that the services provide only the functions and tools that are available at the time of use. CamperPass expressly disclaims any express or implied warranties as to the quality, security, legality of the service or the accuracy of information, unless expressly stated otherwise.

2.4. CamperPass does not guarantee that the services will be available at all times and will operate without interruption or technical errors. It is not liable for damage caused by temporary unavailability of the services.

2.5. CamperPass reserves the right, without notice and without obligation to users, to change, edit or discontinue the platform or the services. If the User does not agree with newly introduced functions, changes or edits, they must immediately stop using the services and close their account.

2.6. CamperPass also reserves the right, without prior notice and without liability to users, to restrict or temporarily suspend the provision of the services, for example where unavoidable platform maintenance work is necessary.

3. Rental agreement

3.1. Prices and conditions

The vehicle Owner sets the desired rental price, additional charges for distance driven, and possible additional fees (e.g. for cleaning, extra equipment, early or late handover / return).

Booking prices and conditions are determined at the time of the booking request and are not changed by later changes made by the Owner to their profile or listing.

The Owner is responsible for setting prices correctly. CamperPass is not liable for prices set incorrectly by the Owner.

3.2. Early return by the renter.

If the renter returns the vehicle early, does not use the agreed mileage or does not use the additional services ordered, this does not give a right to a price reduction or compensation (Article 6.499(1) of the Civil Code of the Republic of Lithuania).

3.3. Booking request.

To rent a vehicle, the Renter submits a booking request to the Owner for the selected dates.

3.4. Booking methods.

Different booking methods may apply on the platform:

  • Instant booking – the renter can confirm the booking without additional confirmation from the owner.
  • Conditional booking – the booking takes effect only after the owner’s confirmation. The renter’s request is considered a binding offer to the Owner. After confirmation the booking becomes binding on both parties (Article 6.162 of the Civil Code of the Republic of Lithuania – conclusion of a contract).

3.5. Booking confirmation and review.

Once the booking is confirmed, both parties can see its details on the platform.

3.6. Insurance

Insurance is not mandatory to make a booking, but if the Renter wishes, they may ask the Owner to provide the insurance terms and the insurance policy.

3.7. Changing the rental period

The rental period cannot be changed through the platform. If the period is extended or the rental amount is increased, this takes place outside the CamperPass platform. The platform is not responsible for any additional charges that may arise and does not undertake to communicate between the Owner and the Renter. All changes made outside the Platform remain the responsibility of the Owner and the Renter.

4. Registration and account

4.1. Creating an account.

The User must create an account following the instructions provided on the platform. The information provided during registration must be correct, complete and valid. Registering under pseudonyms or nicknames is not permitted.

Providing false or misleading information may have legal consequences (Article 6.189(1) of the Civil Code of the Republic of Lithuania – binding nature of a contract).

4.2. Registration restrictions.

  • A User may register only once as a renter and once as an owner.
  • All actions performed through the User’s account are considered to have been performed by the User personally.
  • If third parties use the account, the User is responsible for their actions as for their own.

4.3. Account blocking and re-registration

If CamperPass deletes a User’s account or asks them to stop using the services, the User may not register again, either under the same or under a different name.

4.4. Age requirement

Only adults (from 18 years of age) may register.

4.5. Updating data

The User must immediately update their account data if it changes.

For the platform to work properly, it is important that the information in the account is as accurate and complete as possible. The consequences of inaccurate or incomplete data are borne by the User.

4.6. Protection of personal data

The data provided during registration is processed in accordance with the CamperPass privacy policy, the GDPR and the Law on Legal Protection of Personal Data of the Republic of Lithuania.

4.7. Guarantees regarding submitted content

The User confirms that:

i) they have all rights to the content provided in their account (photos, vehicle data, etc.);

ii) they hold all necessary licences and permissions if the content provided belongs to third parties;

iii) the content provided is not confidential, offensive, defamatory, obscene or threatening;

iv) the content does not damage the reputation of CamperPass;

v) all activities will be carried out in accordance with the applicable laws of the Republic of Lithuania.

4.8. Data verification

The User agrees that CamperPass and its partners may check their creditworthiness, identity, driving history, vehicle ownership documents and criminal record data using reliable external registers, including VĮ “Regitra”, the Lithuanian Transport Safety Administration and other public or private data sources.

The information obtained will not be made public, but may be used in deciding whether to allow access to the platform’s services.

4.9. Security of login credentials

The User is responsible for the security of their login credentials and may not disclose them to third parties.

If a leak of login credentials is suspected, the User must immediately inform CamperPass and change their password.

4.10. The platform’s right to refuse registration

CamperPass has the right to refuse to register a new User or to delete an existing account without giving a reason.

4.11. Providing information to authorities

Information about owners, vehicles and bookings may be provided to law enforcement authorities or other competent Lithuanian authorities upon their lawful request.

5. Vehicle handover and return

5.1. Delivery and pick-up procedure

The owner and the renter agree on the exact place, date and time of vehicle handover. Handover may take place:

  • at the owner’s address;
  • at the renter’s address (for an additional fee, if applicable);
  • at other pre-agreed locations.

5.2. Vehicle condition check

Before the vehicle is handed over, both parties must:

  • carry out an inspection of the exterior and interior condition;
  • record all existing damage (by photos or video);
  • check the mileage, fuel level and equipment set.

This information is included in the handover–acceptance certificate, which becomes part of the rental agreement (Article 6.662 of the Civil Code of the Republic of Lithuania – handover–acceptance certificate).

5.3. Presentation of documents

The Renter must present a valid driving licence, an identity document and other documents required by the Owner.

The Owner must present the vehicle registration certificate, a valid insurance policy (if any) and the technical inspection document.

5.4. Delay in handover or return

  • If the owner is late in handing over the vehicle, the renter may be refunded a proportionate part of the rental price for the time lost.
  • If the renter is late returning the vehicle without the owner’s consent, an additional fee applies for each hour or day of delay, as set out in the rental agreement.
  • In the event of delay, the police may be contacted regarding misappropriation of the vehicle (Article 183 of the Criminal Code of the Republic of Lithuania).

5.5. Fuel policy

The fuel level at return must match the level at handover, unless otherwise agreed.

If the tank is not filled, an additional fee for fuel and service applies.

5.6. Condition discrepancies at return

If the vehicle is returned with new damage or missing equipment, the renter must compensate the damage in accordance with:

  • the handover–acceptance certificate signed by the parties;
  • the applicable provisions of Article 6.249 of the Civil Code of the Republic of Lithuania on compensation for damage.

5.7. Cleaning

The vehicle must be returned in a clean interior and exterior condition, as it was handed over.

If additional cleaning is required or the Owner applies a cleaning fee, the fee provided for in the rental agreement applies.

6. Payments and fees

6.1. Rental price

The rental price and additional fees are set by the Owner and stated in the vehicle listing on the platform. All prices are given in euros (€) including VAT, if applicable, in accordance with the Law on Value Added Tax of the Republic of Lithuania.

6.2. Payment procedure

  • The renter must pay the full rental price (or part of it, if an advance payment system is permitted) through the platform using the payment methods offered (payment card, bank transfer, online banking, etc.).
  • The rental is considered confirmed only once payment has been received.
  • CamperPass acts as a payment intermediary, collecting the renter’s funds and transferring them to the owner in the agreed manner.

6.3. Deposit (security deposit)

  • The owner may set a deposit (security deposit) for the rental period.
  • The deposit is held until the vehicle is returned and its condition has been checked.
  • If damage is found, the amount of the damage is covered from the deposit and the remainder is returned to the Renter.
  • If the damage exceeds the deposit, the renter must pay the difference (Articles 6.256 and 6.249 of the Civil Code of the Republic of Lithuania – liability for non-performance of obligations and compensation for damage).

6.4. Additional fees

The Owner and the Platform may charge additional fees for:

  • late return of the vehicle;
  • fuel shortage;
  • additional cleaning;
  • traffic rule violations during the rental;
  • breaches of the terms of the agreement.

All such fees must be clearly stated in the vehicle listing or the return rules.

6.5. Administrative fees

CamperPass may charge an administrative fee for cancelling a booking, changing the agreement or other service administration actions, of which the User is informed in advance.

6.6. Unpaid amounts

If the renter does not pay the full amount due:

  • late payment interest may be charged (up to 0.05% for each day overdue, unless otherwise agreed);
  • the information may be passed to a debt collection company or a court;
  • the ability to use the platform’s services may be restricted.

6.7. Payment protection

All payments through the platform are made using secure payment channels that comply with the requirements of the GDPR and the Law on Payments.

7. Cancellation and refund policy

7.1. Cancellation terms

The renter may cancel a booking only through the platform. The cancellation terms and fees depend on the policy set by the owner, which must be clearly stated in the vehicle listing.

Possible models (examples):

  • Flexible policy – full right to a refund if cancelled at least 48 hours before the start of the rental.
  • Moderate policy – 50% refund if cancelled at least 7 days before the start of the rental.
  • Strict policy – no refund if cancelled less than 14 days before the start of the rental.

7.2. Platform administrative fees

The platform’s administrative fees (if applicable) for a booking may be non-refundable, unless the booking is cancelled due to the owner’s fault or force majeure circumstances. In that case the booking fee is refunded from the Owners’ booking fund.

7.3. Cancellation due to the owner’s fault

If the Owner cancels a confirmed booking:

  • 100% of the rental price paid and the deposit are refunded to the Renter.
  • The Owner may be subject to a service fee or platform sanctions (temporary suspension of listings, rating reduction, etc.).

7.4. Cancellation due to force majeure

Both parties may cancel the agreement without additional fees if force majeure circumstances occur, as defined in Article 6.212 of the Civil Code of the Republic of Lithuania. Such circumstances include: natural disasters, acts of war, prohibitions by state authorities, epidemics, transport restrictions and the like. In such cases the full amount paid is refunded, except for costs already actually incurred and justified.

7.5. Refund period

Refunds are made within 14 calendar days of the cancellation confirmation, using the same payment method by which the payment was made.

7.6. Partial refund

If the rental period is shortened after it has already started (e.g. the renter returns the vehicle early):

  • Money for unused days may be non-refundable, unless the Owner agrees otherwise.
  • The Platform may charge an administrative fee for changing the agreement.

7.7. Contractual penalties

If the agreement is cancelled in breach of the established terms, contractual penalties may apply (Article 6.71 of the Civil Code of the Republic of Lithuania), the amount of which must be clearly stated in the vehicle listing.

8. Rules for using the vehicle

8.1. Permitted use

The Renter undertakes to use the vehicle only for its intended purpose – travel and leisure – in compliance with traffic rules, insurance terms and the Owner’s instructions.

8.2. Driver requirements

  • Minimum driver age – 21 years (unless the owner determines otherwise).
  • The driver must hold a valid driving licence entitling them to drive the vehicle’s category.
  • Driving experience – not less than 2 years (unless the owner determines otherwise).
  • Only persons named in the rental agreement may drive.

8.3. Fuel and operating conditions

  • The vehicle is handed over with a full fuel tank and must be returned in the same condition (unless the owner determines otherwise).
  • The renter is responsible for proper operation of the vehicle (tyre pressure, oil level, coolant, etc.).
  • Any repair work is carried out only with the Owner’s consent.

8.4. Prohibited

The Renter is prohibited from:

  • handing the vehicle over to third parties without the Owner’s consent;
  • using it for racing, sporting events, off-road driving, or carrying loads exceeding the permitted weight;
  • smoking in the vehicle or using open flames;
  • transporting dangerous, illegal or prohibited substances;
  • altering the vehicle’s structure or technical parameters.

8.5. Travel restrictions

  • Travel abroad is permitted only with the Owner’s prior written consent.
  • The owner may specify countries or regions to which travel is prohibited.
  • The renter is responsible for all customs, road toll, insurance and other formalities during the trip.

8.6. Technical problems

  • The Renter must immediately inform the Owner of any breakdown or accident.
  • If the incident requires a police report (e.g. a traffic accident), it must be drawn up on the spot in accordance with the requirements of the Road Traffic Rules of the Republic of Lithuania or the legislation of the other country where the incident occurred.

8.7. Renter’s liability

The Renter is liable for all damage caused to the vehicle or to third parties during the rental period if the damage resulted from their fault or breach of the rules (Articles 6.256 and 6.263 of the Civil Code of the Republic of Lithuania).

9. Vehicle pick-up and return

9.1. Pick-up place and time

The vehicle must be picked up at the place specified by the Owner and at the agreed time stated in the rental agreement.

9.2. Condition check before pick-up

  • Before accepting the vehicle, the Renter and the Owner or their representatives jointly inspect the vehicle’s technical and cosmetic condition.
  • During the inspection a vehicle condition report is drawn up, recording all existing defects, scratches, dents, the fuel level, etc.
  • The Renter must sign the report to confirm awareness of the condition.

9.3. Returning the vehicle

  • The vehicle must be returned to the Owner or their authorised representative at the agreed place and time, except where both parties agree otherwise in writing.
  • The vehicle must be in the same condition as at pick-up, except for normal wear and tear.

9.4. Condition check on return

  • When the vehicle is returned, a detailed condition inspection is carried out again and a return report is drawn up.
  • If new damage is found, the renter is informed of the possible consequences under the rental agreement and Lithuanian law.

9.5. Late return

  • For late return of the vehicle, the additional day or hour rates provided for in the rental agreement apply.
  • A delay exceeding 24 hours without the Owner’s consent is deemed termination of the agreement without return of the deposit.

9.6. Unsuitable vehicle condition on return

  • If the vehicle is returned damaged, dirty or with other problems that go beyond the normal wear and tear provided for in the agreement, the owner has the right to demand compensation.
  • The amount of compensation and the payment procedure are determined in accordance with the Civil Code of Lithuania and the rental agreement.

9.7. Loss or theft of the vehicle

  • The Renter must immediately notify the Owner and law enforcement of the loss or theft of the vehicle.
  • The renter is liable for the damage if the loss or theft occurred due to their negligence or breach of the terms of the agreement.

10. Damage, liability and additional costs

10.1. Covering damage

  • The Renter is liable for all damage to the vehicle and its equipment that occurs during the rental period, except for normal wear and tear.
  • The amount of compensation is determined on the basis of the actual repair or replacement costs, taking into account the age and depreciation of the vehicle.

10.2. Insurance and deductible

  • If the vehicle is insured, the Renter’s liability is limited to the amount of the insurance deductible provided for in the insurance contract.
  • If the insurance does not cover rental activity, the Renter is liable for the full amount of the damage.

10.3. Reporting damage

  • The Owner must, within 48 hours after the vehicle is returned, notify the Renter and the Platform of any hidden damage that has appeared.
  • Without a damage notification, the Renter may consider the rental agreement completed and no longer accept claims for damage.

10.4. Providing evidence

  • The Owner must provide evidence of damage (photos, repair invoices, expert assessments) to substantiate the need for compensation.
  • The Renter has the right to review the evidence and provide their own explanations.

10.5. Additional costs

  • The Renter is liable for additional costs, such as late-return penalties, vehicle cleaning, servicing, and payment of road tolls or fines.
  • The Owner and the Platform may charge an administration fee for administering additional actions and costs.

10.6. Theft or damage to the vehicle due to the renter’s fault

  • If the vehicle is stolen or damaged due to the Renter’s negligence, they must compensate the full damage, including lost income and repair costs.
  • The Renter must immediately inform the Owner and law enforcement about theft or other incidents.

10.7. Dispute resolution

  • If disputes arise regarding the amount of damage or liability, the parties must first try to resolve them through negotiation.
  • In the event of disagreement, disputes are resolved in court in accordance with the laws of the Republic of Lithuania.

11. Rating system

11.1. Every User may rate other users on the platform.

11.2. The User must submit only truthful, objective and well-founded ratings. False, offensive or otherwise unlawful and unfounded comments are prohibited.

11.3. Using the rating system in a way that does not match its purpose is prohibited. This applies in particular to ratings given between related persons, non-existent users, or self-ratings.

11.4. CamperPass does not review the content of ratings and is not responsible for their truthfulness or validity. CamperPass reserves the right to delete ratings or comments without prior explanation.

12. Payments and fees

12.1. The Renter pays the rental price agreed with the Owner in the rental agreement.

12.2. Normally 20% of the rental amount is invoiced to or charged from the Renter after the Owner’s confirmation or after an instant booking is made. The remaining 80% must be paid no later than 14 days before the start of the rental period.

12.3. If the rental agreement is concluded less than 14 days before the start of the rental, the full rental amount is paid after the Owner’s confirmation or after the instant booking is made.

12.4. Payment deadlines and percentages may be changed unilaterally by CamperPass, and the current information is provided on the platform.

12.5. Payments are made in the Owner’s currency, and the platform may display indicative prices in different currencies according to the renter’s language selection. The Renter understands that currency conversion rates and bank/payment card fees may be unfavourable, and CamperPass does not compensate for any losses incurred as a result.

12.6. The Owner is responsible for providing a bank account in the same country and currency in which the vehicle listing is registered. If another account is agreed with CamperPass, additional fees for currency conversion or other processing costs may apply.

12.7. CamperPass reserves the right to charge a platform service fee, which is automatically added to the rental price set by the owner. This fee may be changed for new bookings.

12.8. Payments may be processed by a third party. The Owner receives the money after the Renter has successfully checked in and paid. The transfer of funds may take up to 10 days.

12.9. The Renter undertakes to pay a deposit, which may also be paid on arrival if CamperPass permits. The deposit is used to cover additional costs or damage after the end of the rental period.

12.10. If an insurance claim arises, the deposit is withheld until the case is resolved. The deposit may be used to cover the insurance deductible.

12.11. The Owner may request that the deposit be withheld for longer for an investigation or insurance case. The Owner must ensure that the investigation is carried out promptly.

12.12. The Renter authorises CamperPass to store and charge their payment method for future payments (e.g. deductibles), using Stripe or a similar payment system.

12.13. Owners are prohibited from demanding a deposit for vehicles that they have no right to rent out. Violations are subject to strict fines and suspension of the account on the Platform.

12.14. Attempting to deceive another user or the Platform is subject to extremely high fines.

12.15. All fines and additional costs must be paid within 30 days of arising; otherwise late payment interest of 5% applies for each day overdue.

12.16. The Owner is responsible for declaring their income and fulfilling VAT obligations. The Platform is not responsible for users’ tax compliance.

12.17. The Platform provides only intermediary services and is not responsible for taxes that users are required to pay.

12.18. Users authorise the platform to manage payments in Stripe or a similar payment system in accordance with the rental agreements.

⸻

13. Intellectual property rights

13.1. CamperPass is the owner of all lawful copyrights in the service and the public platform content.

13.2. CamperPass grants Users a limited, personal, revocable, non-exclusive right to use the platform in accordance with the CamperPass rules.

13.3. Without CamperPass’s written consent, it is prohibited to copy, use large parts of the database content, or systematically collect information with robots, spiders or crawlers, except as provided in the robots.txt file.

13.4. These terms do not provide for the transfer of any intellectual property rights to Users.

13.5. Users should not take actions that infringe CamperPass’s intellectual property rights, such as registering identical domain names or company names.

13.6. Content published by Users remains their property, but by uploading information they grant CamperPass a free, worldwide, sublicensable, non-exclusive right to use that content to provide and promote the platform’s services.

13.7. It is prohibited to hide, alter or destroy information about intellectual property rights, as specified in the platform’s rules.

14. Liability

CamperPass is only an intermediary providing brokerage services and is not liable for damage or other relations between the Owner and the Renter.

Any loss attributable to CamperPass is limited to a maximum amount of EUR 500. The total liability arising from this agreement shall never exceed this amount.

CamperPass is not liable for damage arising from:

  • information obtained from third parties or from third-party websites linked to CamperPass;
  • information published by users on the platform;
  • loss of or damage to property or a vehicle;
  • death or personal injury;
  • traffic or parking rule violations;
  • fuel costs;
  • breaches of this part of the agreement by other users;
  • termination of a rental agreement, or removal of accounts, vehicles or other platform assets.

The User guarantees that CamperPass is not liable for any damage or costs, including but not limited to damage due to (alleged) infringement of intellectual property rights, third-party claims, debt collection costs, legal costs, loss of income, fines and legal fees, arising from: (i) CamperPass’s non-conformity with these terms; (ii) use of the services; or (iii) damage.

The User undertakes to indemnify CamperPass against all claims that may be brought against CamperPass by third parties (including other Users) due to the User’s breach of the agreement. The User assumes all costs incurred by CamperPass as a result of such breaches, including the costs of legal disputes (also before proceedings are started). Other claims and demands for damages by CamperPass remain unaffected.

15. Termination

Users of CamperPass services have the right to stop using the service and delete their account at any time. An account cannot be closed if there are active bookings. Closing an account does not affect rental agreements already concluded.

If there are indications that a user has violated legislation, the rights of third parties (including other users) or the provisions of the agreement with CamperPass, or the user has received several negative ratings, CamperPass has the right, at its discretion, to take the following actions: (i) warn the user; (ii) delete certain entries; (iii) temporarily block the user or a rental agreement; (iv) terminate a rental agreement; (v) block the user for a long period or delete their registration and terminate the contractual relationship without prior notice. CamperPass’s right to claim additional losses or initiate other legal action remains reserved.

If a user is to receive a payment from CamperPass or has a positive account balance at the time of termination, CamperPass guarantees that the corresponding amounts will be transferred to the user.

All outstanding fees owed by users must be paid immediately after the account is closed.

16. Other terms

These terms and any disputes related to or arising from them are governed by the laws of Lithuania.

All disputes arising from or related to these terms are resolved in the courts of general jurisdiction. If the dispute is with CamperPass as a party, it must be resolved in a Lithuanian court in accordance with the Code of Civil Procedure of Lithuania.

If any provision of these terms is found to be invalid, the remaining terms remain valid, and CamperPass will replace the invalid provision with one as similar as possible.

If you provide paid services similar to those of CamperPass, whether your customers are businesses or private individuals, you are deemed to be competing with CamperPass. You are prohibited from using the website, downloading material or obtaining content from the platform, directly or indirectly. If you breach this condition, you are liable for any losses caused and must account for the benefit obtained. CamperPass reserves the right, at its discretion, to deny any person access to the website, the services or the data.

CamperPass reserves the right to assign or pledge all rights, obligations and documents under these terms to third parties and will inform you of this. By using the platform, you agree to cooperate with any such third party and to allow it to exercise all rights acquired upon the assignment.

If the Renter and the Owner have a dispute over an amount not exceeding the maximum amount of one incident, both parties agree to resolve the dispute directly. CamperPass holds the deposit for the booking and may give advice, but accepts no responsibility for resolving the dispute. If both parties submit documents to CamperPass but mutual agreement or clarity is not reached, CamperPass will return 50% of the deposit to the Renter and pay 50% to the Owner. If it is clear that a different split of the deposit is fairer, CamperPass may choose a different split. If one of the parties wants a different solution, both the Renter and the Owner agree to direct court or other actions only against their counterparty, and not against CamperPass.

CamperPass is not responsible for advice or its implementation.

Email is sufficient for all notices under this agreement. The written form, as provided in these terms or the agreement, also includes emails.
